BREAKING NEWS: Supreme Court Rules in Favor of Debt Collector

This morning the Supreme Court of the United States (SCOTUS) issued an opinion in Midland Funding, LLC v. Johnson (Case No. 16-348, U.S. Supreme Court), overturning an Eleventh Circuit decision that found Midland Funding, LLC (Midland) in violation of the Fair Debt Collection Practices Act (FDCPA) for filing a proof of claim in a Chapter 13 bankruptcy on an out-of-stat debt.

Another "Tax Consequence" Case, Another Decision - This One Positive for Collectors

On May 5, 2017 a U.S. federal magistrate judge in Wisconsin dismissed a Fair Debt Collection Practices Act (FDCPA) putative class action regarding 1099(c) language in a settlement letter. The case is Dunbar v. Kohn Law Firm SC (Case No. 17-cv-88, U.S. District Court, ED, WI).
